Q: Alright, here is how it goes. My parents went away on vacation for a couple of weeks. They live in MD, I had some time off, so I went to watch the dog for a couple of days. During that time, i used my dad's car. He has a 2007 BMW X3. I parked it in the garage in PARK. I went to work out for about an hour. To finish my workout, I walked up the court and back. When I came back to the area where the garage is, I saw the X3 has against a tree with the alarm going off. It was still in park and it was unlocked, with the keys in it (the neighborhood is safe enough to do that.). The entire rear window was shattered and the back is completely wrecked. I talked to my dad and he believes it is not my fault. The car is still where I found it. I believe it runs and drives. What should I do? This is the first problem with the car ever. Should I call my local BMW Dealer? Should I call corporate? What should I do? Thanks

A: The car is under warranty, if there is a transmission problem, they will fix it. Consequential damage, however, would have to be proven was caused by the transmission. Whether BMW will pick this up or not will become a case between them and your insurance company (you will have to claim it, since it is a collision). You may have to pay the deductible. It will be a tough case, sorry to say. Since the keys were in it, it is possible it was driven and wrecked. I know you said it's a safe neighborhood, but can you prove no one got in and drove it? You should probably file a police report too, just in case. Sometimes insurance companies demand that, whether you know what happened or not.
